Understanding the Party Wall Act

The Party Wall etc. Act 1996 is designed to prevent and resolve disputes between neighbours when construction works affect shared or adjacent structures. It provides a clear legal framework for protecting both properties and maintaining neighbourly harmony.

The Act covers three main categories:

1. Section 1 – Line of Junction Works: Building a new wall at or astride the boundary line.

2. Section 2 – Party Structure Works: Alterations or repairs to an existing party wall or structure, such as inserting steel beams or raising the height of the wall.

3. Section 6 – Adjacent Excavations: Excavating within three or six metres of an adjoining property, depending on foundation depth.

We prepare and serve accurate Party Wall Notices, undertake Schedules of Condition, and draft Party Wall Awards that clearly set out the rights and responsibilities of both parties. Our professional process ensures compliance, prevents disputes, and gives you complete legal protection.

Planning to extend, convert your loft, or add a basement? If your project affects a shared wall or neighbouring boundary, the Party Wall Act requires you to serve formal notice on your neighbour(s).

We handle the entire process for you — from reviewing drawings and serving notices to conducting inspections and preparing awards. Our involvement ensures that your works proceed lawfully and without unnecessary delays.

Before construction begins, we carry out a Schedule of Condition on your neighbour’s property to record all existing defects. This protects you from potential false damage claims and provides documented evidence for peace of mind.
We manage all communication and coordination with your neighbours or their surveyor, so you can focus on your project with confidence.

If you’ve received a Party Wall Notice, you are legally entitled to appoint your own surveyor to protect your interests. We can act on your behalf to ensure that your property is fully safeguarded during your neighbour’s construction works. We will:

  • Review the proposed works and all drawings.
  • Conduct a thorough Schedule of Condition before works commence.
  • Liaise directly with your neighbour’s surveyor.
  • Ensure the Party Wall Award includes clear protection clauses and damage provisions.
  • Our role is to act impartially yet firmly, ensuring your property remains protected and that any damage or inconvenience is handled professionally. We help maintain good neighbourly relations while ensuring your legal rights are upheld at every stage.
