The Act provides a legal framework to prevent and resolve disputes between neighbours when building works affect shared or adjoining structures. It ensures both properties are protected during construction.

You must serve notice before carrying out works such as building on or near a boundary, cutting into a party wall, or excavating within three or six metres of a neighbouring property.

For most works, at least one month’s notice is required for excavation and two months for works to an existing party wall.

If there’s no response within 14 days, a dispute is deemed to have arisen, and a surveyor can be appointed under Section 10(4) of the Act to act impartially on their behalf.

It’s a detailed record of the neighbouring property’s current condition before works begin. It protects both owners by documenting any existing defects with photographs and written descriptions.

A legally binding document prepared by surveyors that sets out the rights and obligations of both parties, including working hours, access arrangements, and how any damage will be made good.
